What qualifies as domestic abuse under the law in England and Wales?
Domestic abuse includes physical violence, emotional abuse, coercive control, sexual abuse, financial control and harassment. It does not require physical harm – controlling, threatening or degrading behaviour also qualifies.
How quickly can I get a Non-Molestation Order?
We can often help you apply for a Non-Molestation Order on the same day, especially in urgent or high-risk situations. In emergency cases, this type of Order can be granted without the other party being notified (known as a ‘without notice’ application).
What is coercive control?
Coercive control is a form of domestic abuse that involves a pattern of ongoing manipulation, intimidation, or emotional abuse, intended to isolate and control a partner, former partner or family member. It may not be physical, but can be just as harmful.
Do I need to go to court to get a Non-Molestation or Occupation Order?
You may need to attend a court hearing, particularly where the Order is contested by the other party. However, we will handle the application process and provide full legal representation and support throughout, ensuring that we are by your side from start to finish.
Do I need to report the abuse to the police first?
No, you can apply for an injunction through the Family Court without involving the police, although you can also report abuse to them separately, and should call 999 immediately if you are in imminent danger. We can discuss the best route for your individual situation.
